Panattoni Development Company, Inc. (“Panattoni,” “we,” “us,” or “our”) respects its Canadian users’ (“you”, “your”) privacy and values your trust. The purpose of this Panattoni Canadian Privacy Policy (“Privacy Policy”) is to inform you of the types of information we may collect from you when you use our website at www.panattoni.com (“Site”), our social media channels, third-party services we use, and/or through the performance of our professional services (collectively, the “Services”). This Privacy Policy forms part of our Terms of Use, available.
Please read this Privacy Policy carefully to understand our practices regarding your information and how we will treat it. By using the Services, you agree to the collection, use and disclosure of information, including personal information (defined below), in accordance with this Privacy Policy. If you provide Personal Information, defined below, to us relating to other individuals, you are responsible for communicating the terms of this Privacy Policy to them.

- Collection of Personal Information.
In this Privacy Policy, “Personal Information” means information about an identifiable individual. This includes but is not limited to sensitive personal information that entails a reasonable expectation of privacy. For example, Personal Information may include: information about you such as email address, online identifiers and name.
- Agreement to Terms.
By using the Services, you consent to our Privacy Policy. If you do not agree with the terms of this Privacy Policy and our Terms of Use, then you should immediately discontinue use of the Services without providing us with any Personal Information.
- Information We Collect.
Panattoni collects the following categories of information, including Personal Information, from you: (a) directly from you if you contact us via email, for example, if you apply for a job at Panattoni or make other inquiries; (b) in the course of our Services to you or others, including documents or communications; (c) from third parties performing services on our behalf (e.g., webinars, presentations) or recruiters as part of the recruitment process; (d) from the device and browser that you use to access the Services; and (e) cookies and similar technologies.
- Identifiers. We may collect your name, email address, postal address, telephone number, and signature.
- Professional or Employment-related Information. We may collect the name of the company you work for or represent and your position. We may also collect your past employment history (e.g., company name, job title, office location) as part of our recruiting process.
- Government Identifiers. We may collect government identifiers as part of our business acceptance procedures, our provision of legal services, or our recruiting procedures. This information may include a copy of your passport or other government identification card.
- Education Information. We may collect information such as your educational degrees, institutions attended, professional memberships, qualifications, and certifications.
- Financial Information. We may collect payment information, such as your bank account details or credit card information.
- Device Information. We collect device information when you visit the Site. This includes your computer or mobile device type, browser type, unique identifiers, IP address, and geolocation information.
- Internet or Electronic Network Activity Information. You are not required to provide all Personal Information identified in this Privacy Policy to use our Services or to interact with us, but certain functionality will not be available if you do not provide certain Personal Information. For example, if you do not provide certain Personal Information, we may not be able to respond to your requests.
- Our Use of Personal Information.
We collect and use the information collected about you, including Personal Information, for the following purposes:
- Providing the Site and Services to You. We use Personal Information to provide you with our Services. If the applicable information is to be provided to, or the Services are to be performed by, a third party, then we will disclose the applicable Personal Information to the third party. Personal Information collected by us may be available or provided to a third party that is contractually obligated to protect Personal Information as disclosed in this Privacy Policy.
- Managing, Administering, and Improving our Services. We use Personal Information from you for our everyday business operations, such as supporting and administering the Services. Personal Information collected from you may also be used to improve the content and/or functionality of the Services.
- Managing our Relationship with You, Responding to Inquiries or Requests, and Communicating with You. We may contact you to provide notices about any changes to the Services, and subject to applicable law, regarding promotions or other communications that may be of interest to you.
- Analyzing use of the Services. We collect certain information about you, including Personal Information, in order to improve our Site and Services.
- To Enforce Compliance with Our Terms of Use and this Privacy Policy. When you use our Services, you are bound to our Terms of Use and this Privacy Policy. To ensure compliance, we process your Personal Information by actively monitoring, investigating, preventing and mitigating any alleged or actual prohibited, illicit or illegal activities on our Services.
- Security. We collect Personal Information to ensure the security of our Services, including security incident and protecting against malicious, deceptive, fraudulent, or illegal activity, or prosecuting those responsible; and
- Complying with our Legal and Regulatory Obligations. Our Services are subject to certain laws and regulations that may require us to process Personal Information.
Please note that we comply with Canada’s anti-spam legislation (CASL), and we will not send you electronic communications in contravention of this law.
We will further ensure that our electronic communications with you include an opt-out feature and instructions on how to un-subscribe if you no longer wish to receive future communications from us. You can unsubscribe using the link included in the communication or by sending an email to unsubscribe@panattoni.com. If you do not expressly consent to receiving electronic communications, we will only communicate with you for the limited purposes permitted under CASL.
- Our Disclosure of Personal Information.
Panattoni may disclose your information, including Personal Information, with third parties as follows:
- Service Providers. We may from time to time use other third parties (“Service Providers”) to perform certain services on our behalf, such as information technology Service Providers, third parties to whom we outsource support services such as photocopying and document review, web analytics providers, marketing providers, and payment processing services. We provide our Service Providers with the information reasonably necessary for them to perform the services on our behalf. We use commercially reasonable efforts to require each Service Provider must agree (a) to implement and maintain reasonable security procedures and practices appropriate to the nature of the information involved in order to protect your information from unauthorized access, destruction, use, modification or disclosure, and (b) not to retain, use, or disclose the information for any purpose other than for the specific purpose of performing their services for us, or as otherwise permitted by law.
- To Perform our Services. We may disclose information in the course of performing professional services on behalf of our clients, including to advisors, financial institutions, other professional advisors, lawyers, auditors, notaries, business continuity support Service Providers, and other legal, tax, and risk and compliance advisors.
- Legal Purposes. We may disclose your information for legal reasons, e.g., to government bodies (including tax authorities), dispute resolution organizations, law enforcement agencies, or other third parties, (a) if we are legally required to do so (for example, in response to subpoenas, court orders or legal process) or to establish, protect or exercise our legal rights or defend against legal claims; (b) to protect the rights and property of Panattoni or the public; (c) if we believe it is legally or ethically necessary in order to investigate, prevent or take action regarding illegal activities, fraud, violations of the personal or intellectual property rights of others, or situations involving potential threats to the safety of any person.
- Changes to our Business. We may disclose information with third parties in connection with a change to the control or financial status of the company, including a corporate restructuring, sale, acquisition, financing, reorganizations, bankruptcy, receivership, transfer, or assignment of assets or business amalgamation. Personal Information and other information may be shared in the diligence process with counterparties and others assisting with the transaction and transferred to a successor or affiliate as part of that transaction.
- Aggregated Information. We may use and disclose aggregated data and information for any purpose, for example, in order to describe the use of our Services to our existing or potential business partners and clients, or other third parties. However, this aggregated data and information will not involve the disclosure of individual information and will not personally identify you or other users of our Services.
- Children’s Privacy.
The Site is not intended for users under the age of 16 or the equivalent age of majority in your jurisdiction and Panattoni does not knowingly collect Personal Information from individuals under the age of 16. If you are aware of, or suspect that, someone under the age of 16 is using the Service without permission, please notify us immediately by contacting our Privacy Officer at the email address as detailed below.
- Cookies.
We store certain information that is collected automatically at our end through cookies and other similar technologies on the Site. A cookie is a small string of information that a website that you visit transfers to your browser for identification purposes. Cookies can be used to follow your activity while using a website or across websites, and that information helps companies understand your preferences and tendencies, as well as improve and personalize your website experience. Some cookies are necessary to operate a website, while others can be functional or used for analytics. Cookies on the Site are generally divided into the following categories:

For example, on the preccelerator.com website, we embed certain videos that are hosted on Google’s YouTube website. Google sets certain functional cookies to remember your preferences (e.g., your preferred language), to remember user input, and to detect and resolve problems with Google’s services. You can prevent the use of certain cookies by modifying your Internet browser settings, typically under the sections “Help,” “Internet Options,” or “Settings.” If you disable or delete certain cookies in your Internet browser settings, you may still access the Site, however, you might not be able to access or use important functions or features of the Site.

You may disable the use of cookies by modifying your browser settings but note that doing so may alter the features you are able to access the Services.
- Security.
We maintain reasonable technological, organization and physical measures to protect Personal Information from loss, improper or unlawful access, misuse, alteration, or unintentional destruction consistent with applicable data protection laws. We have implemented various security measures to protect the information that we receive from you. We cannot guarantee the security of any information that you disclose online. The transmission of your information via the internet is not completely secure. We cannot guarantee the security of Personal Information transmitted through our Services. To the extent permitted under applicable law, we assume no liability or responsibility for disclosure of your information due to errors in transmission, unauthorized access by third parties, or other causes beyond our control.
- Data Retention
We retain Personal Information for as long as necessary to fulfill the purposes for which the information was collected; provide you with the Services and comply with our legal obligations.
- Accessing and Correcting Personal Information.
You may access, review and correct your Personal Information by sending us an email at the coordinates listed below. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. You also have the right to data portability, which includes the right to request that computerized Personal Information be communicated in written, intelligible transcript request that collected Personal Information be communicated to you in a structured, commonly used format. This section lists the privacy-related rights that we extend to you. The right to know and right to deletion are not absolute and are subject to certain exceptions. For example, we cannot disclose specific pieces of Personal Information if the disclosure would create a substantial, articulable, and unreasonable risk to the security of the Personal Information, the applicable account with us or the security of our systems.
- Right to Know. You have the right to know the Personal Information we collect, use, and disclose about you.
- Right to Deletion. You have the right to request that we delete any Personal Information we have collected or maintain about you. We may save Personal Information when permitted by applicable law including, without limitation, when the Personal Information is needed for a legal purpose.
- Right to Correction. You may modify your Personal Information by contacting our Privacy Officer at the coordinates listed below.
- Right to Learn on Request. You have the right to learn about your Personal Information on request and informed when we make a decision solely based on automated personal decision making.
You may also request that we provide you with a copy of your Personal Information in a commonly used electronic format so that it can be managed and moved. Please note that we may ask you to verify your identity before responding to such requests. There is no cost for such access request unless you require copies of records. We may not be able to provide you with access to your Personal Information if the information cannot be separated from the Personal Information of others, cannot be disclosed for reasons of security or commercial confidentiality, or is protected by legal privilege. If we cannot provide you with access to your Personal Information, we will advise you of the reasons access is being denied, unless we are prohibited by law from doing so.
- Transferring Personal Information.
Our Services are currently accessible within Canada and the United States. If you are accessing the Services in Canada, please note that the Personal Information collected will be kept in the United States and maintained on servers located in the United States. Accordingly, your Personal Information may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to the laws in those jurisdictions. For example, information may be shared in response to valid demands or requests from government authorities, courts and law enforcement officials in those countries. Subject to applicable laws in such other jurisdictions, we will use reasonable efforts to protect the Personal Information.
We may engage Service Providers to perform certain services on our behalf and to otherwise provide the Services. These third parties may store, process and transfer Personal Information on servers located outside of Canada in jurisdictions whose data protection laws may differ from those of Canada, such as the United States. Subject to applicable laws in such other jurisdictions, we will use reasonable efforts to cause our Service Providers to protect the Personal Information.
- Links to Other Websites.
For your convenience, we may link to third-party sites and services, or otherwise display third-party content through our websites to provide increased value to our visitors. We have no control over these linked sites, each of which has separate privacy and data collection policies and practices independent from us. As such we have no responsibility or liability for these independent policies or actions and are not responsible for the privacy practices or the content of any such websites. Please note that these other sites may send their own cookies to users, collect data, or solicit Personal Information, and we encourage you to review their policies before engaging with these third-party sites.
- Effective Date and Changes to this Privacy Policy.
This Privacy Policy is effective as of the date at the top of this policy. Panattoni has the discretion to update this Privacy Policy at any time. When we do, we will revise the effective date at the top of this page. We encourage users to frequently check this page for any changes and to stay informed about how we protect the Personal Information we collect, especially before you provide information, and particularly Personal Information, directly to us through the Services. In the event of a material change to this Privacy Policy, we will provide a message through our website or via email informing you of the change.
